Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of lecasquedor.com (the “Site”) and your participation in the Casque d’Or vote for the Greatest Formula One Driver of All Time (the “Vote”). The Site is operated by Grand Epreuve Pty Ltd (ACN 702 257 065), Level 10, 387 George Street, Sydney NSW 2000 (“we”, “us”). By using the Site or casting a ballot, you accept these Terms.
1. Who may use the Site
The Site is open to visitors worldwide and is launched first in Australia. During the Australian launch phase, to cast a ballot you must be an Australian resident aged 18 or over and confirm this on the ballot form. If you are under 18, please do not submit personal information.
2. The Vote
The Vote is a public, editorial poll designed to celebrate 75 years of Formula One World Championship history. It is not a lottery, sweepstake, trade promotion, prize competition or game of chance. No purchase is necessary. No prize is offered to voters and voting confers no commercial benefit.
The mechanics of the Vote — eligibility, ranking, scoring, tie-breaks and announcement — are set out in the Voting Rules, which form part of these Terms.
3. Your ballot
- One ballot per person, enforced by unique email address.
- You confirm that the name, email and Australian residency and age confirmation you submit are your own and are accurate.
- We may refuse, disqualify or delete any ballot that appears to be duplicated, automated, fraudulent or otherwise submitted in breach of these Terms.
4. Acceptable use
You agree not to:
- use bots, scripts or any automated means to submit ballots or scrape the Site;
- attempt to bypass the one-vote-per-person control, including by using disposable or third-party email addresses;
- interfere with the security or availability of the Site;
- use the Site in a way that infringes the rights of any driver, team, sponsor or other person.
5. Intellectual property
Casque d’Or® is a registered trade mark. “Grand Épreuve”, the Site design, the editorial copy and the graphic identity are owned by us or our licensors. Driver names, team names and championship references are used for editorial and historical identification only; no endorsement or affiliation by any driver, team, the FIA or Formula One Group is claimed or implied. Photographs are used under licence or with permission of the rights holder; all rights of the original photographers and agencies are reserved.
You may share links to the Site freely. You may not copy, reproduce or redistribute substantial portions of the Site without our written consent.
6. How the result is described
The result is a tally of public ballots cast on this Site. It is editorial opinion, not a statement of objective fact about any driver. We publish the ballot count, the exclusion criteria and the scoring method alongside the result so that anyone can see how it was produced.
7. Disclaimer
The Site is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted or error-free. Editorial content reflects the opinions of Casque d’Or and its contributors.
8. Liability
To the extent permitted by law, we exclude liability for indirect, incidental or consequential loss arising from your use of the Site. Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer-protection law.
9. Australian consumer rights
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted or modified by agreement. Where our liability for a failure to comply with a consumer guarantee can be limited, our liability is limited (at our option) to supplying the relevant service again or paying the cost of having it supplied again. The choice-of-law clause below does not displace the Australian Consumer Law where it applies to conduct in Australia.
10. Consumer rights (EEA / UK)
If you use the Site as a consumer in the EEA or the United Kingdom, you keep the benefit of any mandatory consumer-protection rights available where you live; these Terms do not override them.
11. Changes
We may update these Terms from time to time. The “Last updated” date on this page shows the most recent change. Material changes affecting the Vote will be announced on the Site.
12. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State. Consumers elsewhere may also bring proceedings in the courts of the country where they live, and mandatory local law continues to apply.
